David Faithful, consultant to Lyons
Davidson Solicitors recently posed the question to a group
of delegates at a conference:-
| 'If an employee driving in
a private car on business was involved in a
fatal accident today, could your company prove
it had done everything it could to meet its duty
of care?' |
David Faithful warned that one employer
had already been hit by a £1 million claim as a result of a
company driver using their private vehicle on business being
involved in in a crash and found not to have insurance
covering business use.
As a result, the driver's insure pulled
cover and the business automatically became liable for the
claim.
